Terms of Service

1. Definitions

• “PerfBee” means Techpiks Bilgi Teknolojileri Ticaret ve Limited Şirketi (Techpiks Information Technologies Ltd.), operating as Techpiks Digital Solutions, and its PerfBee product and services.
• “Customer” / “you” means the individual or entity accessing the service.
• “Service” means the PerfBee web performance analytics platform, including the dashboard, API, and RUM script.
• “Credits” means the unit of consumption for platform actions (audits, crawls, extractions).
• “Content” means data, audit results, reports, and other outputs generated through the Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use PerfBee. If you are using PerfBee on behalf of a company or organization, you represent that you have authority to bind that entity to these Terms.

3. Account Registration

You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

You may not share your account with others or create accounts for the purpose of abuse or circumventing limits.

4. Service Description

PerfBee provides web performance analytics tools including:

• Lighthouse performance audits with AI-powered fix suggestions
• Real User Monitoring (RUM) via a lightweight JavaScript snippet
• Site crawling for broken links and on-page SEO analysis
• Critical CSS extraction and inlining tools
• A REST API for programmatic access

We reserve the right to modify, suspend, or discontinue any feature with 30 days' notice for material changes. Emergency modifications for security or legal reasons may be made without notice.

5. Credits & Fair Use

Credits are allocated monthly according to your plan and do not roll over. Credit costs per action:

• Fast site crawl: 1 credit per page
• Full SEO crawl: 4 credits per page
• Performance audit: 2 credits per run
• Critical CSS extraction: 3 credits per URL

PerfBee reserves the right to throttle or suspend accounts engaging in excessive or abusive usage patterns that negatively affect platform performance for other users.

6. Payment & Billing

Paid plans are billed in advance on a monthly or annual basis. All prices are in USD. Billing is handled by our payment provider. You authorize us to charge your payment method on file at each renewal period.

If payment fails, we will retry up to 3 times over 7 days. After that, your account may be downgraded to the Free plan and your data retained for 90 days.

Taxes: prices displayed are exclusive of applicable taxes (VAT, GST, sales tax). Tax is calculated based on your billing address and added to your invoice.

7. Free Trial

The Starter plan includes a 14-day free trial, once per account. A payment method is collected at checkout, but you are not charged during the trial. If you do not cancel before the trial ends, your subscription starts and your payment method is charged the plan price for the first billing period. You can cancel at any time before the trial ends from the Billing section of your dashboard, and your account then returns to the Free plan.

All payments are non-refundable except as required by applicable law or as stated in our Refund Policy.

8. Acceptable Use

You agree not to use PerfBee to:

• Crawl or audit websites you do not own or have permission to analyze
• Conduct denial-of-service attacks or deliberately overload third-party servers
• Violate any applicable law or regulation
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Resell or sublicense the Service without our written consent
• Use the Service to collect personal data from website visitors in violation of applicable privacy laws
• Use automated tools to scrape, copy, or extract data from the Service

Violation of these terms may result in immediate suspension or termination of your account without refund.

9. Intellectual Property

PerfBee retains all intellectual property rights in the Service, including software, trademarks, and logos. You retain ownership of your data and content. You grant PerfBee a limited, non-exclusive license to process your data solely to provide the Service.

You may not use our trademarks, brand names, or logos without our prior written permission.

10. Confidentiality

Each party agrees to keep confidential any non-public information received from the other party and to use it only for the purposes of this agreement. This obligation does not apply to information that is publicly available, independently developed, or required to be disclosed by law.

11. Data Processing Agreement (DPA)

For customers subject to GDPR, we act as a data processor for RUM data collected from your website visitors. Our Data Processing Agreement is available upon request at [email protected] and is incorporated into these Terms by reference. You are responsible for ensuring a valid legal basis under GDPR for the performance data collected via the RUM script. You are solely responsible for providing required notices and obtaining any necessary consent from your website visitors.

12. Uptime & Service Levels

PerfBee targets 99.5% monthly uptime for the dashboard and API. Uptime is calculated based on our internal monitoring systems and excludes scheduled maintenance and force majeure events. Scheduled maintenance will be announced with at least 24 hours' notice where possible. Business and Agency plans include enhanced uptime SLAs as specified in your order form.

Service credits for downtime exceeding SLA thresholds are the sole remedy for service unavailability and are available upon written request within 30 days of the incident.

13. Disclaimers

The service is provided “as is” and “as available”

PerfBee makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be error-free, uninterrupted, or that audit results will achieve specific performance improvements.

AI-generated code fix suggestions are provided as guidance only. PerfBee does not guarantee that AI-generated suggestions are secure, complete, or compliant with applicable law. You are solely responsible for testing and deploying any code changes on your website.

14. Limitation of Liability

To the maximum extent permitted by applicable law, PerfBee's total liability for any claims arising out of or related to these Terms shall not exceed the greater of (a) the amounts you paid to PerfBee in the 12 months preceding the claim or (b) $100 USD.

In no event shall PerfBee be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business, even if advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless PerfBee, its officers, directors, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

16. Termination

You may cancel your account at any time from the billing settings in your dashboard. Cancellation takes effect at the end of the current billing period.

PerfBee may terminate your account immediately for: material breach of these Terms, non-payment, fraudulent activity, or legal requirements. Upon termination, your access to the Service will cease and your data will be deleted within 90 days (except billing records retained for legal compliance).

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict of law principles. To the extent permitted by applicable law, disputes shall be subject to the exclusive jurisdiction of Istanbul courts and enforcement offices.

Notwithstanding the above, PerfBee's servers are located in the European Union and all data processing complies with GDPR requirements.

For EU/UK customers, nothing in these Terms affects your statutory rights under local consumer protection law. EU customers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/odr.

For disputes not resolved informally, the parties agree to attempt good-faith negotiation before initiating formal proceedings. Either party may seek injunctive relief in a court of competent jurisdiction to prevent irreparable harm.

18. Changes to Terms

We may update these Terms at any time. We will provide at least 30 days' notice before material changes via email and in-dashboard notification. Continued use after the effective date constitutes acceptance. If you do not agree to the new Terms, you may cancel your account before the effective date.

19. General

• Entire agreement: These Terms, together with the Privacy Policy and any order forms, constitute the entire agreement between you and PerfBee.
• Severability: If any provision is found unenforceable, the remaining provisions remain in full force.
• Waiver: Failure to enforce any provision does not constitute a waiver of future enforcement.
• Assignment: You may not assign these Terms without our written consent. PerfBee may assign these Terms in connection with a merger, acquisition, or sale of assets, provided that such assignment does not materially reduce customer protections under these Terms.
• Force majeure: Neither party is liable for delays caused by circumstances beyond their reasonable control.
